By Executive Order, The National Park Service (NPS) is developing an Off-Road Vehicle (ORV) management plan/environmental impact statement and regulation for Cape Hatteras National Seashore (CAHA).

The NPS has contracted with the U.S. Institute for Environmental Conflict Resolution to assess the feasibility of using negotiated rulemaking to reach consensus among interested parties in development of the required special regulation for CAHA. This facilitated approach has been used in other national park sites to reach consensus on regulations.

If negotiated rulemaking is feasible, the NPS would carry out and complete the rulemaking process concurrently with the development of an ORV Management Plan for the park and accompanying National Environmental Policy Act (NEPA) analysis. The NPS has assigned a high priority to the completion of this plan/environmental impact statement and regulation.

Participating in this entire process has been UFWDA's legislative advocate, Carla Boucher.

Boucher reports that the final days of negotiated rulemaking committee meetings for Cape Hatteras are occuring on February 26 and 27.

In addition to this official meeting, there is an afternoon meeting of access organizations to caucus on the development thus far in negotiations undertaken in February by a newly formed integration subcommittee. The integration subcommittee was formed for the purpose of gathering a few representatives from various interests that could gather in face-to-face meetings for a final try at reaching consensus and negotiating a reasonable solution for ORV management at the seashore. UFWDA is one of 9 organizations on the integration subcommittee.
