A state court judge has ruled that Amagansett property owners failed to prove that they are the rightful owners of two sections of beach that are popular with 4x4 vehicle owners on summer weekends and dismissed their lawsuit against East Hampton Town claiming the use of the beach creates a public nuisance.

The judge, Supreme Court Justice Ralph T. Gazillo, said in his decision that the case presented by attorneys for a group of homeowners associations failed to provide convincing proof that the beach was included as part of the fee title to land sold by the East Hampton Town Trustees in the late 1800s and has been held in private ownership since that time.
